Technology Services and Projects

ITP Law helps clients throughout selecting and negotiating for information technology, telecommunications and software systems. Subject matter we advise on includes:

  • software licences

  • telephony and network services

  • website design

  • software development

  • systems integration

  • IT outsourcing

  • service level agreements

  • e-commerce and website terms and conditions

  • contract audits

We work on all phases of the technology sourcing life-cycle and can play a key role in the following:

1. Planning

Defining goals and requirements aligning negotiation objectives with broader business plans, analysing existing agreements, defining requirements, confirming time frames, managing communications with key interest groups and decision makers. We work within multi-disciplinary project teams, including project managers, technical experts, legal resource, subject matter experts, business representatives and procurement professionals.

2. Going to Market

Exploring deal structure options and alternatives for approaching the market, designing and building tender documentation, drafting model agreements, and managing communications both externally and internally.

3. Evaluation

Forming an evaluation team, and confirming evaluation criteria. Scheduling vendor presentations and reference site visits. Assessing alternate options arising from the RFP responses. Facilitating final scoring and communication of outcomes to all candidates.

4. Negotiation

Translating the sourcing process and outcome into an effective agreement. Tracking bid responses and ensuring negotiations correspond to the proposals made. We bring a practical, problem-solving approach to a process where implementation and an ongoing relationship will matter for both customer and vendor.

5. Implementation

Tracking implementation against the plan specified in the agreement. Assisting with exit from any existing agreements. Communicating changes internally and externally.

6. Management

Implementing benchmarking and price comparison exercises. Supervising and documenting change requests on an ongoing basis. Providing assistance with agreement interpretations. Preparing for future renegotiations and tender processes.
